Information on the Protection of Personal Data
As Vucut Terapi ve Bakim Hizmetleri Ticaret Limited Sirketi (“SCULPTURE”), we attach great importance to the security of your personal data. We keep all personal data shared by our patients with care for patient privacy and by taking all necessary technical and administrative measures to ensure an appropriate level of security. This Information on the Protection of Personal Data explains our data-protection and processing policy and how we collect, transfer, use and protect your personal data during the services provided by SCULPTURE.
1. Personal Data Collected by SCULPTURE
Within the scope of the healthcare services we provide, we collect various information in accordance with the data-processing principles and conditions of Law No. 6698 on the Protection of Personal Data (“KVKK”). The information we collect may include:
- Your name and surname;
- Your ID information and passport number;
- Your place and date of birth;
- Your gender;
- Your address;
- Your phone number;
- Your email address;
- The patient protocol number assigned to you by Sculpture;
- Financial data such as payment and billing information;
- Private health insurance or Social Security Institution data;
- Biometric data within services financed by the Social Security Institution;
- Health data including, but not limited to, laboratory and test results, examination data, check-up information and prescription information;
- A voice recording taken with your consent if you contact SCULPTURE;
- CCTV image recording during your visit;
- Your vehicle plate data if you use the parking/valet service;
- Health data and identity information you share when using the online services on our website sculpture.com.tr;
- Other data you share when contacting us by email, call center or other channels.
2. Purposes of Processing Your Personal Data
The personal data we collect is processed for various purposes, including: (a) fulfilling our legal obligations under Law No. 3359 on Basic Healthcare Services, Decree-Law No. 663, the Private Hospitals Regulation, the Regulation on Processing of Personal Health Data and Ensuring Privacy, and other relevant regulations; (b) protecting public health, preventive medicine, medical diagnosis, treatment and care services, and the planning and management of healthcare services and their financing; (c) informing you about your appointment if you make one; (d) planning and managing SCULPTURE internal operations; (e) analysis to improve our services; (f) billing; (g) verifying your identity; (h) verifying your relationship with contracted institutions; (i) responding to requests of the Ministry of Health and other public institutions; (j) responding to your questions or complaints; (k) analyzing your use of healthcare services to improve them; (l) compliance with SCULPTURE internal policies; (m) measuring and increasing patient satisfaction; (n) contacting you for informational purposes about our services; (o) procurement of medicines or medical devices. Apart from the activities listed above and cases required by law, your personal data will not be used for any commercial purpose.
3. Persons and Organizations to Whom Your Data May Be Transferred
By taking all necessary technical and administrative measures, your data may, for the purposes in Section 2, be shared with: institutions permitted by Law No. 3359, Decree-Law No. 663, the Private Hospitals Regulation, the Regulation on Personal Health Data and other relevant legislation; private insurance companies; our direct/indirect domestic/foreign shareholders, subsidiaries and/or affiliates and group companies; auditors, advisors and business partners; domestic/foreign organizations with which we contractually cooperate; the group of companies to which the company belongs; your employer; our suppliers, support-service providers, archive-service providers and business partners; the Social Security Institution; the General Directorate of Security and other law-enforcement agencies; the General Directorate of Civil Registration; the Turkish Pharmacists Association; judicial authorities; laboratories, medical centers, ambulance, medical-device and healthcare providers with which we cooperate for diagnosis and treatment, in Turkey or abroad; the healthcare institution to which the patient is referred or applies; your authorized legal representatives; third parties we consult, including lawyers, tax advisors and auditors; and other third parties.
4. Method and Legal Basis of Collecting Personal Data
Your personal data is collected and processed in any verbal, written, visual or electronic medium for the purposes above and so that all work within SCULPTURE field of activity can be carried out within the legal framework and SCULPTURE can fully and properly perform its contractual and legal obligations. The legal bases are: Law No. 6698; Law No. 3359; Decree-Law No. 663; the Private Hospitals Regulation; the Regulation on Processing of Personal Health Data and Ensuring Privacy; Ministry of Health regulations and other legislative provisions. As stated in Article 6(3) of the Law, personal data on health and sexual life may be processed without the explicit consent of the data subject only for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, and the planning and management of healthcare services and financing, by persons under a confidentiality obligation or authorized institutions.
5. Your Rights Regarding Your Personal Data
Under Article 11 of the KVKK, by submitting a request form in person, via notary, or to info@sculpture.com.tr with a secure electronic signature, you have the right to: (a) learn whether your personal data is being processed; (b) request information about the processing; (c) learn the purposes of processing; (d) learn the third parties to whom your data has been transferred domestically or abroad; (e) request correction of incomplete or incorrect data; (f) request deletion or destruction of your data; (g) object to adverse results arising from automated processing; and (h) request compensation for damages caused by unlawful processing. SCULPTURE will conclude the request free of charge as soon as possible and within thirty days at the latest. If the operation entails a cost, a fee under the tariff set by the Personal Data Protection Board will be charged.
6. Data Security and Right of Application
Your personal data is carefully protected with technical and administrative means at a level appropriate to possible risks. You can submit your requests under the Law by completing the “Application Form under the Personal Data Protection Law” on www.sculpture.com.tr and delivering it in person to Gul Sokak No:11 1. Soltas Evleri, Akatlar/Etiler, Istanbul, sending it via notary, or sending it to info@sculpture.com.tr with a secure electronic or mobile signature.
I have read and understood the Clarification/Information Text on the Processing of Personal Data prepared by SCULPTURE; I have been informed about the purposes of processing, the institutions and health professionals to whom my data is transferred, the collection methods and legal bases, my rights, data security and my right of application; and WITH MY FREE WILL AND EXPLICIT CONSENT I ACCEPT the processing, storage and transfer of my personal and special-category data in accordance with this text.
